These Terms of Use and Conditions of Sale govern your use of evarisseco.com and any purchases made from Evarisse & Co, operated by Eliza Evarisse.

By accessing our website or placing an order, you agree to these Terms. If you do not accept them, you should not use the website or purchase from us.

We aim to keep our website available, secure and accurate. However, uninterrupted or error-free access cannot be guaranteed.

We may temporarily suspend or restrict access to all or part of the website for maintenance, repairs, security updates or the introduction of new features. Where reasonably possible, we will try to minimise any disruption.

We may update, withdraw or change any part of the website without prior notice.

3. Permitted Use

We grant you a limited, personal, non-exclusive and revocable right to access and use our website for lawful, non-commercial shopping purposes.

Without our prior written permission, you may not:

  • copy, reproduce, republish or commercially exploit our website or its content;

  • collect product listings, descriptions, photographs or prices;

  • use data-mining tools, crawlers, robots, spiders or similar automated technology;

Ordinary search-engine indexing carried out by legitimate search-engine operators is permitted.

Nothing in these Terms transfers any intellectual-property rights to you. You may not reproduce or use our protected content except for personal use or where applicable law permits it.

5. Your Conduct

You must use the website lawfully and responsibly.

You must not use the website:

  • for fraud, criminal activity or any unlawful purpose;

  • to submit material that is abusive, threatening, defamatory, obscene or discriminatory;

  • to infringe another person’s copyright, trademark, privacy or other rights;

  • to distribute malware, harmful code or unsolicited commercial communications;

  • in any way that could damage, overload or disrupt the website or its users.

You are responsible for the accuracy and legality of information and electronic communications you send to us.

6. Product Information

We make reasonable efforts to ensure that product descriptions, measurements, materials, prices and photographs are accurate.

Product images are provided for illustrative purposes. Colours may appear differently depending on lighting, photography and device-display settings. Images may not show products at their actual size. Please review the measurements and specifications stated on the relevant product page before ordering.

Materials and product characteristics are described on each product page based on the information available to us. If you have an allergy or sensitivity to a particular metal or material, contact us before purchasing.

Availability may change without notice. We may correct mistakes in descriptions, prices, photographs or specifications and may update a product where reasonably necessary.

Nothing in this section limits your legal rights where a product is faulty, not as described or unfit for its intended purpose.

7. Jewellery Care

Jewellery requires appropriate care to maintain its appearance and condition.

We recommend that you:

  • put jewellery on after applying cosmetics, perfume, lotion or hairspray;

  • remove jewellery before bathing, swimming, exercising, sleeping, cleaning, gardening or performing manual work;

  • avoid prolonged exposure to moisture, chemicals and direct sunlight;

  • store each piece carefully to prevent tangling and scratching;

  • handle clasps, chains and fasteners gently;

  • regularly inspect fasteners and settings for wear;

  • avoid abrasive or unsuitable cleaning products.

Damage resulting from misuse, an accident, normal wear and tear or failure to follow reasonable care instructions is not considered a manufacturing defect. This does not affect your statutory rights where a product was faulty when supplied.

8. Placing an Order

We currently accept orders for delivery to addresses in England.

By submitting an order, you confirm that:

  • the information you provide is complete and accurate;

  • you are authorised to use the selected payment method;

  • sufficient funds are available to complete the purchase;

  • you have reviewed the product description, price and delivery information.

After placing an order, you will receive an acknowledgement by email. This acknowledgement confirms that we received your order but does not necessarily mean that it has been accepted.

A binding contract is formed when we confirm that your order has been accepted or dispatched.

We reserve the right to refuse or cancel an order where reasonably necessary, including when:

  • payment is declined, unauthorised or identified as potentially fraudulent;

  • a product is unavailable;

  • incorrect information was displayed about a product or its price;

  • we cannot deliver to the address provided;

  • the order appears to have been placed for unlawful or unauthorised purposes;

  • we cannot verify important order information after making reasonable attempts to contact you.

If we cancel an order after receiving payment, we will refund the amount paid using the original payment method.

9. Prices and Payment

All prices are displayed in euros (€) unless clearly stated otherwise.

The complete amount payable, including applicable taxes and delivery charges, will be shown before you submit your order.

Delivery charges may vary depending on the order and destination. The applicable charge will be displayed during checkout before payment.

Prices may change without notice. Changes will not affect an order that we have already accepted, except where an obvious pricing error has occurred.

Payment must be completed using one of the methods offered during checkout. We do not have to dispatch an order until payment has been authorised.

10. Delivery

We deliver to addresses in England.

The available delivery method, estimated delivery period and applicable delivery charge will be shown during checkout before you place your order.

Delivery dates are estimates unless we explicitly agree that a particular date is essential. Delays may occur due to circumstances outside our reasonable control, including carrier disruption, customs processing, severe weather or incorrect delivery information.

Unless a different delivery period is agreed with you, we will deliver your order without undue delay and no later than 30 days after the contract is formed.

You are responsible for supplying a complete and accurate delivery address. We cannot be responsible for delays or failed delivery caused by incorrect or incomplete information supplied by you.

All products included in one order will normally be sent to one delivery address.

11. Cancelling Before Dispatch

If you wish to cancel an order before it has been dispatched, contact us as soon as possible at support@evarisseco.com.

Include your name and order number.

We will try to stop the order, but cancellation before dispatch cannot be guaranteed once processing has started. If the order has already been dispatched, you may use your cancellation and return rights described below.

12. Right to Cancel and Change-of-Mind Returns

If you are purchasing as a consumer, you may cancel an eligible online order without giving a reason within 14 days after the day on which you receive the goods.

To exercise this right, email support@evarisseco.com with a clear statement that you wish to cancel. Please include your name and order number.

After notifying us, you must return the goods within the following 14 days.

Unless the goods are faulty, damaged or incorrectly supplied, you are responsible for the direct cost of returning them. Contact us before sending anything back so we can provide the appropriate return instructions.

You must take reasonable care of returned products. You may inspect them as you would in a physical shop, but we may reduce the refund where unnecessary handling has reduced the product’s value.

Any legal exception to the right to cancel will be clearly communicated before purchase where it applies.

13. Faulty, Damaged or Incorrect Products

You are entitled to receive products that are of satisfactory quality, fit for purpose and as described.

Contact support@evarisseco.com promptly if an item arrives faulty, damaged, incorrect or materially different from its description.

Please provide:

  • your name;

  • your order number;

  • a description of the problem;

  • photographs where reasonably available and helpful.

Photographs can help us investigate and resolve the issue more quickly, but requesting them does not remove or restrict your statutory rights.

Depending on the circumstances and your legal rights, we may offer a repair, replacement, price reduction or refund. Where a valid return results from a fault, damage or our error, we will bear the reasonable return cost.

Consumers may have a short-term right to reject qualifying faulty goods within 30 days. Additional rights may continue after this period.

14. Refunds

Approved refunds will be returned to the original payment method.

For a valid change-of-mind cancellation, we will refund:

  • the price paid for the returned products; and

  • the standard outbound delivery charge, where required by law.

We do not have to refund additional costs resulting from your choice of a more expensive delivery method than our least expensive standard option.

We may wait until we receive the returned goods or receive acceptable evidence that they have been sent back, whichever occurs first.

Refunds will be processed within the period required by applicable law. Your bank or payment provider may require additional time to credit the money to your account.

15. Risk and Ownership

Responsibility for the goods passes to you when they are delivered to you or to a person you have authorised to receive them.

Ownership passes to you once we have received full payment for the goods.

16. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful. This includes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, and your statutory consumer rights.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses resulting from circumstances outside our reasonable control.

If you use our website or purchase products for business purposes, we are not responsible for loss of profit, revenue, business, anticipated savings, data or business opportunity.

17. Third-Party Services and Links

Our website may contain links to third-party websites or use services provided by payment processors, carriers or other independent providers.

We are not responsible for the content, security, availability or privacy practices of websites or services that we do not control. Your use of third-party services may also be subject to their own terms.

18. Changes to These Terms

We may update these Terms to reflect changes to our website, products, operations or legal obligations.

The version in force when we accept your order will normally apply to that purchase. Updated Terms will be published on evarisseco.com together with a revised update date.

19. Governing Law

These Terms and any contract between you and Evarisse & Co are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, subject to any mandatory consumer rights that entitle you to bring proceedings elsewhere.

20. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be adjusted or removed only to the extent necessary. The remaining provisions will continue in effect.

21. Entire Agreement

These Terms, together with the information presented during checkout and any other policies expressly incorporated into them, form the agreement between you and Evarisse & Co concerning your purchase.

Nothing in these Terms limits rights that cannot lawfully be excluded.
